Who these terms are for

Octopus POS is sold to businesses — shops, restaurants, cafés, salons, hotels — not to consumers. By creating an account or installing the apps for your business, you confirm you are at least 18 and allowed to act for that business.

What you get

The Octopus POS apps for Windows and Android tablets and the kitchen display, and — with the Pro edition — Octopus Manager and sync between your devices. What your plan includes (edition, number of POS, locations) is written in your quote or subscription.

Your licence

  • We give your business a non-exclusive, non-transferable right to use Octopus POS for its own activity, for as long as your subscription or licence is paid.
  • You may install it on the number of POS your plan allows.
  • You may not resell, rent, copy or reverse-engineer the software, or get around the number of POS on your plan.
  • The software stays ours. Your data stays yours.

Prices and payment

  • Every fee — subscription, number of POS, set-up, hardware — is written in your quote before you pay. There are no other charges.
  • The quote shows whether prices include VAT.
  • If a payment is late, we tell you by email and give you at least 14 days before we pause the online service. Your data is kept, and you can still export it.
  • Subscriptions can be refunded within 14 days — see the refund policy.

Working offline

The POS is built to keep selling without internet: every sale is saved on the device first and sent to our servers when the connection comes back. That means:

  • Until a device has synced, its latest sales exist only on that device. If it is lost, broken or reset, or the app is uninstalled, before it syncs, we cannot recover those sales.
  • You are responsible for your devices, your shop’s network, your printers and your internet connection.
  • Check the sync status regularly, and keep the automatic local backup switched on (Windows).

The online service

We work to keep our servers available at all times, but we cannot promise a service that never stops: networks and hosting providers fail. Planned updates are announced by email in advance, and the POS keeps selling while they run.

Your responsibilities

  • Keep passwords and PIN codes private, and remove staff who leave.
  • Check your tax rates, prices and receipt details. You set them, and your business stays responsible for its tax and legal obligations.
  • Use Octopus POS lawfully, and have a lawful reason for the customer data you record.

Your data

Your data belongs to you. We process it only to provide the service, as the privacy policy explains. You can export it at any time. When your account closes, you have 30 days to export it before it is erased.

Limits of our liability

  • We fix reported bugs within a reasonable time, but the software is provided as it is, without a promise that it is free of every error.
  • We are not liable for indirect losses such as lost profit, lost sales or lost business, nor for sales lost on a device before it synced.
  • Our total liability over any 12 months is limited to the fees you paid us in those 12 months.
  • Nothing here limits a liability that the law does not allow us to limit, such as for fraud or gross negligence.

Stopping the service

You can stop at the end of any subscription period, with no cancellation fee. We may end the service if these terms are seriously broken, after a written warning — except in cases of fraud or abuse.

Changes to these terms

We email account owners at least 30 days before a change that matters. If you do not agree, you can stop before it applies.

Law and disputes

These terms are governed by the law of the Kingdom of Morocco. We will always try to settle a disagreement by talking first; failing that, the competent commercial court in Morocco decides.
